Welcome to CareArmor CPR. These Terms of Service ("Terms") govern your use of our website, services, courses, and any related features, including our SMS/text messaging program (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By creating an account, enrolling in a course, making a purchase, or opting in to receive communications from CareArmor CPR, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Eligibility

You must be at least 18 years of age or have the consent of a parent or legal guardian to use our Services. By using our Services, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To enroll in courses and access the student portal, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Course Enrollment and Certification

Course Access: Upon successful enrollment and payment, you will receive access to the course materials through our student portal. Course access is granted to the individual enrollee only and may not be shared or transferred.
Certification: Upon successful completion of the course and passing the final assessment, your certificate will be automatically generated and delivered digitally. CareArmor CPR certifications are nationally recognized by employers, schools, and organizations.
Certification Validity: CPR, First Aid, and AED certifications are valid for the period specified on your certificate. It is your responsibility to renew your certification before it expires.
Academic Integrity: You agree to complete all coursework and assessments honestly and without unauthorized assistance. We reserve the right to revoke certifications obtained through dishonest means.

5. Payment and Refund Policy

Pricing: All prices are listed in U.S. dollars and are subject to change without prior notice. Applicable taxes will be added at checkout.
Payment: We accept major credit cards and other payment methods as indicated during checkout. All payments are processed securely through our third-party payment providers.
Refund Policy: Due to the digital nature of our courses, refunds are handled on a case-by-case basis. If you experience technical issues that prevent you from accessing the course, please contact us within 7 days of enrollment for assistance. Refund requests will not be honored after course completion or certificate issuance.

6. SMS/Text Messaging Terms

By opting in to CareArmor CPR's SMS/text messaging program, you agree to the following:

You consent to receive recurring automated SMS/MMS messages from CareArmor CPR at the mobile phone number you provided. These messages may include enrollment confirmations, course reminders, certification updates, renewal notifications, and promotional offers.
Message frequency varies. You may receive up to 10 messages per month.
Message and data rates may apply. Your mobile carrier's standard messaging rates apply. CareArmor CPR is not responsible for any charges from your carrier.
Opt-Out: You may opt out at any time by texting STOP to any message. You will receive a final confirmation message and no further texts unless you re-subscribe.

Consent is not required for purchase. Opting in to text messages is not a condition of purchasing any course or service.
We will not sell, rent, or share your phone number or SMS opt-in data with any third parties for their marketing purposes.
You represent that you are the owner or authorized user of the mobile device and phone number you provide.
Supported carriers include, but are not limited to: AT&T, Verizon, T-Mobile, Sprint, and most other major U.S. carriers. Carrier participation may vary.
Carrier Disclaimer: Carriers (including but not limited to T-Mobile, AT&T, and Verizon) are not liable for delayed or undelivered messages.
To re-subscribe after opting out, text START or YES to the number you previously received messages from, or re-submit your phone number through our enrollment form.

7. Intellectual Property

All content on our website and within our courses, including but not limited to text, graphics, images, videos, logos, course materials, and software, is the property of CareArmor CPR or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit our content without our prior written consent.

8. Prohibited Conduct

You agree not to:

Use our Services for any unlawful purpose or in violation of these Terms.
Share, transfer, or resell your course access or credentials to any third party.
Attempt to gain unauthorized access to our systems, servers, or other users' accounts.
Interfere with or disrupt the integrity or performance of our Services.
Upload or transmit any viruses, malware, or other harmful code.
Use any automated means (bots, scrapers, etc.) to access our Services.
Misrepresent your identity, qualifications, or affiliation.
Copy, record, or distribute course materials without authorization.

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WHILE OUR COURSES ARE DESIGNED TO PROVIDE COMPREHENSIVE CPR, FIRST AID, AND AED TRAINING, WE DO NOT GUARANTEE ANY SPECIFIC OUTCOME FROM COMPLETING OUR COURSES. REAL EMERGENCY SITUATIONS ARE INHERENTLY UNPREDICTABLE, AND SUCCESSFUL OUTCOMES DEPEND ON MANY FACTORS BEYOND THE SCOPE OF ANY TRAINING PROGRAM.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CAREARMOR CPR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

11. Indemnification

You agree to defend, indemnify, and hold harmless CareArmor CPR and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of our Services, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or our Services shall first be attempted to be resolved through good-faith negotiation. If such negotiation fails, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our Services after any modifications constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

14. Termination

We reserve the right to suspend or terminate your account and access to our Services at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the Services will immediately cease.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CareArmor CPR regarding your use of our Services and supersede all prior agreements, understandings, and communications.
